Terms & Conditions for Booking Holiday Packages

These Holiday Packages Booking Terms (“Booking Terms”) apply to all quotations, reservations, and bookings for flights, accommodation, tours, transfers, activities, travel insurance, and bundled packages facilitated by NAC Travel International Pty Ltd (“NAC Travel”, “we”, “us”, or “our”). NAC Travel acts as a professional travel consultant and intermediary between you and third-party suppliers.

1. Definitions & Interpretation

Client/You: the traveler(s) or paying party. Package: a bundled arrangement (e.g., flight + hotel + activities) curated or facilitated by NAC Travel. Supplier: airline, GDS, consolidator, hotel, tour operator, transfer company, activity provider, cruise line, car-rental, insurer, or any third party fulfilling a service. Business Day: Monday–Friday excluding public holidays in South Africa.

2. Scope; Intermediary Role

NAC Travel is a private consultancy and acts as an intermediary. We do not own or operate airlines, hotels, or tour companies and do not control their availability, schedules, policies, or performance. Your contract for travel components is with the relevant Supplier. We will exercise reasonable care in selecting reputable Suppliers and facilitating your booking.

3. Quotes, Pricing & Currency

  • Dynamic pricing. Fares, taxes, fuel surcharges, hotel rates, and exchange rates are dynamic and may change until paid, ticketed, and confirmed in writing.
  • Currency & FX. Prices may be quoted in ZAR or foreign currency. Your bank may apply FX spreads/fees. Currency conversions are indicative until settlement.
  • Errors & omissions. We may correct manifest errors or inaccuracies in quotes or confirmations; you may accept the correction or cancel (subject to Supplier rules).

4. Deposits, Payments & Invoices

  • Deposits. Deposits secure a provisional reservation and initiate professional services (research, holds, documentation). Deposits are generally non-refundable once work begins, unless expressly stated otherwise.
  • Balance due. Full payment must be received by the due date on your invoice/itinerary; otherwise reservations may be cancelled by Suppliers and re-booking fees may apply.
  • Payment methods. We accept supported methods displayed on your invoice or checkout. Chargeback-prone or high-risk methods may be declined.
  • Administrative fees. NAC professional fees and reasonable admin fees may apply for complex itineraries, urgent changes, or document handling.

5. Amendments, Cancellations & No-Shows

  • Supplier penalties. Amendments/cancellations are subject to Supplier fare/rate rules and may incur penalties, reissue fees, or result in no refund.
  • No-shows. Failure to use any segment or check in on time is treated as a no-show by Suppliers and may void remaining segments without refund.
  • Service fees. NAC may charge a reasonable service fee for processing changes or cancellations in addition to Supplier fees.

6. Refunds (Processed in up to 90 Days)

Where a refund is due under Supplier rules or these Booking Terms, NAC will process the refund within up to 90 (ninety) days from written approval/confirmation of the refundable amount. This window accommodates third-party settlement cycles, BSP/ARC refunds, bank processing, and audit controls.

  • Refundable components. Only the refundable portion as determined by the Supplier (and excluding non-refundable NAC professional fees already rendered) will be returned.
  • Method & payer. Refunds are returned to the original payer using the original method where possible, less any bank/processing charges.
  • Documentation. You must supply required details (e.g., proof of payment, bank letters) to activate the refund workflow.
  • Chargeback overlap. If you initiate a chargeback, the refund workflow pauses until the dispute is resolved (see Clause 13).

7. Supplier Terms & Priority

Your booking is governed by the applicable Supplier’s terms (airline fare rules, hotel policies, tour operator conditions, insurance policy wording). In the event of conflict, the Supplier terms governing the specific service shall prevail over these Booking Terms for that service. NAC will provide or reference key Supplier terms on request.

8. Documentation, Visas & Entry Rules

You are responsible for valid passports, visas, transit visas, residency permits, inoculation records, and any entry/exit requirements for all jurisdictions in your itinerary. We provide general guidance only; immigration and health authorities make all decisions. Boarding or entry denials, delays, or fines resulting from documentation issues are for your account.

9. Travel Insurance

Comprehensive travel insurance is strongly recommended (and may be required for certain packages) to cover medical events, cancellations, curtailment, baggage, supplier defaults, and force majeure disruptions. Insurance is a contract between you and the insurer; claims are processed per policy wording.

10. Health, Vaccinations & Suitability

It is your responsibility to assess fitness for travel, obtain medical advice, and meet vaccination or testing requirements. Adventure or high-activity components carry inherent risks; you participate voluntarily and at your own risk. We may decline to book components that present unacceptable risk profiles.

11. Itinerary Changes & Special Requests

  • Operational changes. Suppliers may alter routes, aircraft, schedules, rooms, or inclusions; NAC will assist with reasonable alternatives per Supplier policies.
  • Rooming & ratings. Star ratings and room types are Supplier-defined and vary by country. Bedding or view requests are not guaranteed.
  • Special requests. Dietary, accessibility, and adjacent rooms are conveyed to Suppliers but remain subject to availability and confirmation on the day.

12. Disclaimers, Liability & Indemnity

  • No warranty. Services are provided using reasonable skill and care but “as available”. NAC is not liable for acts/omissions of Suppliers or events beyond our control.
  • Limitation. To the fullest extent permitted by law, NAC’s aggregate liability for direct loss is limited to the professional fees paid to NAC for the specific booking giving rise to the claim (excluding Supplier charges).
  • Consequential loss. NAC is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of enjoyment, time, or profits.
  • Indemnity. You indemnify NAC against claims arising from your breach of these Booking Terms, Supplier rules, or applicable laws.

13. Chargebacks & Billing Disputes

If you believe there is a billing error, contact Support promptly with evidence. Filing a chargeback without engaging us may delay resolution. Where work commenced or Supplier policies were disclosed, NAC will contest unfounded chargebacks with documentary proof (tickets, vouchers, logs). If a chargeback is reversed in our favour, you remain liable for associated bank/processor fees.

14. Privacy & POPIA/GDPR

NAC processes personal data to quote, book, and manage your travel; verify identity; prevent fraud; and comply with law. Data may be shared with Suppliers and transmitted cross-border to fulfil your booking. We apply reasonable technical and organisational measures. See our Privacy Policy for rights and practices.

15. KYC/AML, Sanctions & Anti-Bribery

We may request identification and run screening checks. We may decline or cancel bookings where prohibited by sanctions, export controls, or anti-corruption laws, or where payment risk is unacceptable. Bribes and facilitation payments are strictly prohibited.

16. Vouchers, Coupons & Promotions

  • Promotional codes must be applied at purchase and cannot be retro-applied. One code per booking unless stated otherwise.
  • Gift vouchers are not legal tender, cannot be exchanged for cash, and expire on the date stated.
  • Promotions may be withdrawn or modified without notice where permitted by law.

17. Force Majeure

NAC and Suppliers are not liable for delays or non-performance due to events beyond reasonable control, including natural disasters, epidemics, government actions, strikes, severe weather, security incidents, or system outages. We will assist with re-accommodation or credits where permitted by Suppliers.

18. Governing Law & Disputes

These Booking Terms are governed by the laws of the Republic of South Africa. Disputes should first be escalated to Support. If unresolved, the parties may attempt mediation; failing which, the courts of South Africa shall have exclusive jurisdiction.

19. Miscellaneous

  • Entire agreement. These Booking Terms plus the relevant itinerary/quotation and Supplier terms form the entire agreement for your package.
  • Severability. If a provision is invalid, the remainder remains enforceable.
  • No waiver. A failure to enforce is not a waiver of rights.
  • Assignment. You may not assign your rights without our consent. We may assign to an affiliate or successor.
  • Updates. We may update these Booking Terms; continued use or proceeding with payment after notice indicates acceptance.
